Morris Mendelsohn sued under § 503 of the Nationality Act of 1940 1 to be de- dared a national of the United States. His complaint was dismissed by the District Court as failing to state a claim upon which relief could be granted. The ■question presented by this appeal is, of ■course, whether the complaint stated a cause of action.

Its allegations may be quickly summarized. Mendelsohn was born in Poland in 1914. At the age of six years he entered the United States in the care of his father and became a citizen through the father’s naturalization in June, 1923.…
