GARDNER, Circuit Judge.
In this action appellant, as assignee of Carrie Garst, administratrix of the estate of Charles H. Garst, deceased, seeks to recover on a policy of life insurance. The parties will be referred to as they appeared in the lower court.
It is alleged in the petition that the defendant issued and delivered the life insurance policy in question on March 11, 1921, whereby it agreed to pay the executors, administrators, or assigns, of the insured, Charles H.
