1Opinion of the CourtSteinert, J.

This is an action to recover a proportionate part of interest maturing upon a note jointly executed by plaintiffs and the defendants Lakota Land & Water Company, a corporation, and M. R. Wood and Georgie W. Wood, Ms wife, the entire interest having theretofore been paid by plaintiffs. Those defendants now appearing as respondents interposed separate demurrers to the complaint, and the same were sustained by the court. The plaintiffs elected to stand upon their pleading, and the court accordingly entered a judgment of dismissal. This appeal was thereupon taken by plaintiffs.
