—In an action, inter alia, for specific performance of a contract for the sale of real propérty, the plaintiffs appeal from so much of an order of the Supreme Court, Kings County (Harkavy, J.), dated January 31, 2002, as granted the defendant’s motion pursuant *707to CPLR 3211 to dismiss the complaint on the ground that it is barred by the statute of frauds.
Ordered that the order is affirmed insofar as appealed from, with costs.
