The plaintiffs in error, Wood, Pentecost & Co., and Alonzo Wattles and Noah Barlow, were sued in a joint action as the makers and indorsers of a promissory note, by the defendants in error. They all joined in pleading the general issue. On the first trial, the case having been twice tried, Wood, Pentecost & Co., the makers, withdrew their plea and suffered a default, but the issue was tried as to the indorsers, and they had a verdict in their favor.
