This suit involves the following alleged state of facts. The complainant, United States Gypsum Company, sold to Kaucher-Hodges & Company, general contractors, who were then engaged in the construction of the Tivoli Hotel at Biloxi, Mississippi, fifty-eight tons of a roof insulation material called pyrocell for the sum of $1269. This material was sold to the general contractor on the faith of a contractor’s bond, executed by the defendant, the Ameri.can Surety Company, a solvent and nationally known concern, as surety.
