The plaintiff, Quinn Brothers, Inc. (Quinn), sued the defendants, trustees of S & W Realty Trust (trust), for payment of a contract balance. The trust counterclaimed for breach of the contract. At a jury-waived trial, the judge determined that Quinn violated the contract and found for the trust on Quinn’s claim. He also determined that the trust had failed to prove damages and therefore found for Quinn on the counterclaim. The trust appealed. We transferred the case on our own motion. We reverse and remand for a new trial.
