MEMORANDUM OF DECISION AND ORDER
ZOBEL, District Judge.
Plaintiff Eric Sarsfield (“Sarsfield”) was convicted of rape in July 1987 and served close to ten years in prison. He was exonerated based on DNA evidence in August 2000. Thereafter he sued the City of Marlborough (the “City”) and a number of *127its current and former employees for federal civil rights violations and state law violations related to his arrest, prosecution and imprisonment. (See Sarsfield v. City of Marlborough, Civ. A. No. 03-10319-RWZ.)
