— Affirming.

Under an indictment of the grand jury of McCracken county charging the appellant with the crime of murder, he was convicted of manslaughter and sentenced to-two years in the penitentiary. He has appealed, insisting on a reversal of the judgment on the grounds that (a) the court erred in refusing to sustain his motion for a continuance; (b) inasmuch as the court overruled his motion for a continuance the court erred in refusing to-sustain appellant’s motion to require the Commonwealth’s attorney to admit the truth of the matter and facts alleged…
