This is an action in tort for damages instituted by plaintiff, Arthur M. Ware, against Orval J. Laiche, for the loss of a horse.

On September 5, 1948, at approximately 3:30 p. m. the defendant, was operating his 1942 Model Chevrolet automobile on U. S. Highway 190 in an easterly direction, enroute from Baton Rouge, Louisiana, through Livingston Parish, Louisiana. The defendant was accompanied by his wife and two children and when he was approximately two miles west of the Village of Livingston, Louisiana, an accident occurred between his car driven by him and a horse owned…
