Dale Robert Chervenell appeals his conviction of robbery in the first degree while armed with a deadly weapon, and a habitual criminal finding.

At the December 9, 1978, trial on the robbery charge, Chervenell's counsel stipulated that the State's witnesses would testify as described in their statements. The court, sitting without a jury, admitted the witness statements into evidence and found Chervenell guilty as charged.
