This is an action brought by the Orchard Mesa Irrigation District to condemn a right of way for a canal to be used as a tailrace for the conveyance of water from its water power and pumping plant to the Colorado river, at a point above the headgate of the Grand Valley Irriga tion Canal. The proposed route crossed a parcel of land owned by the town of Palisade, situated beyond its corporate limits, used by it for a public baseball park, and continued its course therefrom to the Colorado river, through an adjoining', small piece of land owned by the plaintiff in error, Yager.
