This cause comes before the Court upon Defendant’s Motion to Dismiss pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure.

BACKGROUND

This dispute concerns Plaintiffs employment as a busboy/waiter aboard the M/V Majesty of the Seas (“the vessel”), a vessel operated by Defendant.
