The respondent was indicted for murder in the killing of Alice Butler, and convicted of murder in the first degree, at the April Term of Franklin County Court, 1877.

I. The juror Willard was challenged for cause. He admitted that from what he had seen and heard, he had formed an opinion as to the matter to be tried, but was not aware of any prejudice against the respondent, and had no recollection of having expressed an opinion in the premises.
