Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner became disruptive, used profanities and refused to comply with a correction officer’s directives while being *867processed for a visit with his fiancée. He was charged in a misbehavior report with making threats, refusing a direct order, engaging in violent conduct and creating a disturbance, and was found guilty…
