Plaintiff, a Minnesota corporation, brought an action in ejectment in the district court for St. Louis county alleging ownership in fee simple of certain real property located in Virginia, Minnesota, and defendants’ wrongful possession thereof. Defendant Alessio Cupoletti filed an answer and cross complaint therein admitting plaintiff’s legal title to the property, but alleging an oral agreement whereby he became a distributor of plaintiff’s products in the vicinity of Virginia and was given the use and occupancy of the property in connection with his distributorship.
