Certiorari was granted in this case, by reason of the rulings made in the case of General American Life Insurance Co. v. Butts, 193 Ga. 350 (18 S. E. 2d, 542). It brings under review first the rulings made by the Court of Appeals in Sovereign Camp W. O. W. v. Cooper, 62 Ga. App. 390 (8 S. E. 2d, 161), where the plaintifFs petition was tested and held good against demurrer. At the time of that decision applications for certiorari were subject to Eule 50 of this court, then of force.
