SWANSTROM, Judge.

This case had its procedural beginnings in the small claims department of the district court. The defendant originally prevailed following trial but, by an unusual turn of events, the case was reopened and the plaintiff ended up with a judgment for $1,000 plus $27.75 costs. Dissatisfied with the amount of this judgment, and believing it to be void, the plaintiff then sued in the magistrate division of the district court to *395recover a greater sum in damages.
