— This action was brought by the appellee, J. S. Franklin, to recover damages from the Texas Midland Bailroad, the Paris & Great Northern Bailway Company, and the St. Louis & San Francisco Bailroad Company, alleged to have been inflicted upon two carloads of mules and horses while in transit from Bentonville, Arkansas, to Greenville, Texas. It is alleged, in substance, that on the 9th day of August, 1907, Knott & Gilbreath, as consignors, delivered to the defendant, St. Louis & San Francisco Bailroad Company, at Bentonville, Arkansas, twenty-five mules destined to…
