This was an action brought by George S. Emig, in the district court of Ellis county, against Joseph E. Wilson and others, for the specific performance of a contract for the purchase of certain real estate in Ellis county, The facts, so far as they are material, are: Joseph E. Wilson became the owner of the land in controversy in 1869, by a patent from the government; the Union Pacific railway'company had a right-of-way through said land and occupied said right-of-way at the time and before the land was patented to Wilson; in the year 1886, Wilson placed the land in the…
