Appellant (insured) appeals the dismissal of his application for attorney fees incurred on the appeal of his declaratory judgment action. The trial court found it was without jurisdiction to hear the motion. We affirm.

Insured filed a petition for a declaratory judgment against respondent (insurance company) asking for a declaration that his 1978 Oldsmobile insurance policy covered him when he drove an El Camino owned by a third person and was involved in an accident.
