PHILLIPS, Circuit Judge.
J. V. Stryker was tried, convicted and sentenced upon an indictment containing seven counts for violations of section 215 of the Criminal Code, 18 U.S.C.A. § 338.
Count one of the indictment alleged that the defendant unlawfully and fraudulently devised a scheme and artifice for obtaining money and property by means of false and fraudulent pretenses, representations and promises from W.
