Appeal from a judgment of the Supreme Court (McNamara, J.), entered August 27, 2009 in Albany County, which, in a proceeding pursuant to CFLR article 78, granted respondent’s motion to dismiss the petition.

*1322Petitioner, who is serving a prison sentence of 15 years to life upon his conviction of criminal possession of a weapon in the second degree, commenced this CPLR article 78 proceeding challenging a July 2007 determination of the Board of Parole denying his request for parole release.
