In support of the demurrer, counsel in effect insist: (1) That as to the lots to which the plaintiff had no title he can have no cause of action to prevent the imposition of an illegal tax, notwithstanding he had convoyed such lots by warranty deed with full covenants after the taxes were levied. (2) That if he can so sue, at least there should be joined with him the owners of the land named in the complaint.
