Appeal from an order of the Supreme Court (Connolly, J.), entered July 5, 2016 in Albany County, which, among other things, denied certain defendants’ motions to dismiss the complaint.

In 1999, several employers in the health care industry organized the Healthcare Industry Trust of New York (hereinafter the trust), a group self-insured trust that provided workers’ compensation benefits to the members’ employees (see Workers’ Compensation Law § 50 [3-a]; 12 NYCRR 317.2 [i]; 317.3).
