For a number of years prior to February, 1869, the plaintiff resided and did business in the city of Syracuse. In that month he sold the house in which he lived, and hired a house with a few acres of land in the town of Clay for a year, and with his family went into possession of *283said premises about the 1st of March of the same year, and continued to reside therein until about ¡November following, when he moved back into the city, where he still resides.
