It is claimed that the statute of 1862, by which this lien was created and under which the attachment proceedings were instituted is void, as in conflict with the constitutional provision which provides that no person shall be deprived of his property “ without due process of law.”

In Sheppard v. Steele (43 N. Y., 52), it was held that this statute was not unconstitutional as infringing upon the right of trial by jury.
