PROYOSTY, J.
The railroad of the defendant company traverses the Waubun plantation of the plaintiff company east and west, and has been in operation for more than 50 years. The railroad company was proceeding to enlarge its roadbed for an additional track across the plantation when the plaintiff company objected to its doing so, denying that' the railroad owned the land upon which this enlargement was thus attempted to be constructed.
