.KNIGHT, Chief Judge.

This is a suit to restrain the defendant from performing the duties of President of the Switchmen’s Union of North America. The plaintiffs are, or were, members of the Executive Board and the defendant is, or was, during the times hereinafter mentioned, the President of the Switch-men’s Union of North-America.

It is made, to appear that at some'time prior to March, 1953, certain differences between the Executive Board, or members thereof, with the defendant had arisen and these came into the open in discussions commencing, on or about March 20, 1953.
