This case raises the question of the construction and constitutionality of the statutes of the State, of New York, giving a lien for repairs upon vessels, and providing for the enforcement of such lien by proceedings in rem. The statute con*24ferring the lien, so far as it is material, is given in the margin.1 It will be noticed that it expressly excludes liens founded upon maritime contracts.
