This is an action brought by the plaintiff upon two checks. At the conclusion of the trial both parties moved for a directed verdict, whereupon the cause was decided by the trial court in favor of the plaintiff and judgment entered. The appeal is from the judgment. The facts necessary to be stated are as follows: On July 21, 1923, the deputy county treasurer of Wells county drew a check for $500 on the First National Bank of Harvey, payable to the order of the Farmers State Bank of Fessenden.
