Charity Harned died on December 31,1887, leaving to survive a husband and seven children. Her will, with *240a codicil attached, was probated, and a construction of its provisions is necessary to a solution of the present controversy. The entire estate was placed in trust for the benefit of the husband for life, with the direction that he should receive the corpus of the fund in case he recovered from the pecuniary embarrassment under which he then labored.
