This is a habeas corpus action instituted in the district court for Holt County by Everett Gorgen, petitioner, .against Leo S. Tomjack, sheriff of Holt County, Nebraska, respondent. The action is in resistance of an effort, to remove petitioner from the State of Nebraska to the State of Kansas by extradition to answer a charge of being in possession of stolen property pending against him in the justice court in and for the city of Great Bend, Barton County, Kansas. The trial court found that petitioner was unlawfully deprived of his liberty and discharged him from the custody of the sheriff.…
