Appeal from a judgment of the County Court of Schenectady County (Eidens, J.), rendered July 24, 1997, upon a verdict convicting defendant of the crime of driving while intoxicated.

Defendant was observed by a neighbor as he pulled into the driveway between their houses and ran over her son’s bike. She also observed him “swaying”, “stumbling” and “very intoxicated” as he exited the vehicle. After they had words over the incident, she summoned the police.
