Judgment, Supreme Court, New York County (Bernard Fried, J.), rendered July 13, 1998, convicting defendant, upon his plea of guilty, of criminal possession of a controlled substance in the third degree, and sentencing him, as a second felony offender, to a term of 4V2 to 9 years, unanimously affirmed.

Defendant’s suppression motion was properly denied. There is no basis upon which to disturb the court’s credibility determinations, which are supported by the record. Upon observing the livery cab in which defendant was a passenger commit a traffic infraction, the police officers were authorized…
