The Schmulbach Brewing Company, a corporation doing business in the city of Wheeling, Ohio county, having paid a manufacturer’s license as a brewer under sections 54 and 55 of chapter 32 of the Code, was indicted in the criminal court of Wood county for selling without a license therefor. When the case was-called for trial, the facts were agreed as follows: “The defendant, The Schmulbach Brewing Company, is a corporation duly organized, existing and doing business under the laws of the State of West Yirginia and is engaged in carrying on the business of a brewer of beer.
