Arcadia Budding Company (“Arcadia”) and William and Ginger Henderson1 appeal from the February 14, 2002, decision of the Circuit Court of Jefferson County in which the conditional use permit previously issued to them by the Jefferson County Planning Commission (“Commission”) was vacated. Arcadia had sought and obtained the permit for the purpose of developing a residential subdivision known as Harvest Hills.
