Appeal from an order of the Supreme Court (Sise, J.), entered May 9, 2001 in Fulton County, which granted defendant’s motion for summary judgment dismissing the complaint.

*888This wrongful death action stems from a tragic accident which occurred on the Batchellerville Bridge in the Town of Edinburg, Fulton County, when a trailer, on which a 17-foot runabout motorboat was loaded, detached from a vehicle being driven by Celeste R.
