POEEENBARGER, JUDGE:

On an appeal from a decree of the circuit court of Wood •county, Abraham Johnson complains of the dismissal of his bill against the Ohio River Railroad Company, upon a final hearing upon the pleadings and evidence. The suit' is founded upon a contract made between the parties, bearing date February 22, 1883, by which the plaintiff sold, and agreed to convey, to the defendant, a right of way through his farm, situated on the Ohio river, north of Parkersburg, for its road bed and track, and the defendant bound itself to do the following things: (1) “ Build on, the line of…
