— This is a suit brought by the State of Oklahoma at the relation of its Attorney-General to recover for the use of the de-' •positors ’ guaranty fund of said State the sum of $5000 with interest. The case was tried by the court without the aid of a jury, resulting in a judgment in favor of plaintiff in the sum of $6000 and defendant has appealed.
