On motion. This action was brought by the plaintiffs against the defendants on a promissory note dated February 1, 1946, signed by the defendants and payable to the plaintiffs in the principal sum of $5,445 in payments as follows:

“The sum of Twenty-eight Hundred Dollars ($2,800.) on or before August 25, 1946; the sum of not less than One Thousand Dollars ($1000.) on or before October 1, 1947; the sum of not less than One Thousand Dollars ($1000.) on or before October 1, 1948 and the sum of Six Hundred and Forty-five Dollars ($645.) or the balance remaining unpaid on or before October 1, 1949,…
