This is an appeal by the National Brewing Company, appellant, from a judgment in the sum of $5,000, recovered by appellee, for negligently causing the death of one Frederick Schulz. His death was the result of a dust or gas explosion upon the premises of the National Brewing Company, appellant. The case has been tried twice.
