The relator by this original proceeding in mandamus, seeks induction into the office of Attorney General of the State of West Virginia. The facts are undisputed.

A vacancy occurred in the office of attorney general by reason of the resignation of Honorable C. W. Meadows, who had been elected to that office for a term commencing January 13, 1941, and ending on the Monday following the second Wednesday in January, 1945. The respondent, Honorable W. S.
