CAMMACK, Chief Justice.
At approximately 5:00 p. m. on February 16, 1950, a 72 year old pedestrian, Martha Baker, was struck and fatally injured by a truck operated by Willie Wayne Frederick. This truck was owned by and used in the business of Will Frederick, the father and employer of Willie Wayne Frederick. Garth Mays, administrator of the deceased’s estate, brought this action against the Fred-ericks to recover damages to the estate.
