LEEDY, J.-

Charged by information in the Circuit Court of St. Louis County with murder in the first degree, in having shot and killed one John Currie on September 26, 1934, appellant was convicted under said information of murder in the second degree. The jury assessed his punishment at ten years’ imprisonment in the state penitentiary, and, after an unavailing motion for a new trial, be appealed.
