Plaintiff Jan L. Austin has filed a motion seeking relief from the Court’s Order dismissing her complaint for want of prosecution. Ms. Austin contends that her failure to prosecute the action was due to her previous counsel’s misrepresentations to her about the status of the case, and that, as a result, she only learned of its dismissal five years after the fact, when she made inquiries to the Clerk of the Court.
