Barnes v. Seligman

Appeal from judgment on report of referee. Action by Oliver W. Barnes against Jesse Seligman, James Seligman, and David Seligman, as executors of Joseph Seligman, deceased, and George H. Brown, to recover damages for breach of contract. From a judgment entered on report of a referee, and from two orders,—one granting an extra allowance of $1,000 to the defendants Seligman, and the other granting allowance to defendant Brown,—plaintiff appeals.

In the statement of facts upon which the legal questions which are to be discussed arose it will not be necessary to advert to but a few of those found by the referee. This action was brought to recover $200,000, with interest from the 16th of May, 1872, as damages for the breach of a contract dated the 26th day of March, 1872, made by Joseph Seligman and George H. Brown with the plaintiff in the following language:
