This action originally filed in the Circuit Court of Jefferson County, Alabama, Bessemer Division, was removed to this court pursuant to 28 U.S.C. §§ 1441 and 1446 by Wells Fargo Bank, N.A. (“Wells Fargo”), which'the parties dispute to be either a “counter-defendant” or a “third-party defendant.” (Doc.11).
