In a negligence action to recover damages for personal injuries, the defendant Village of Mamaroneck appeals from an order of the Supreme Court, *828Westchester County (Wood, J.), entered November 17, 1989, which denied its motion for summary judgment dismissing the complaint insofar as it is asserted against it.

Ordered that the order is reversed, on the law, without costs or disbursements, the motion is granted, the complaint is dismissed insofar as it is asserted against the defendant Village of Mamaroneck, and the action against the remaining defendant is severed.
