THAYER, Circuit Judge.

This action, which was instituted by Charles S. Hinchman, the defendant in error, against Lewis C. Nelson and Henry M. Noel, the plaintiffs in error, was tried in the lower court without the intervention of a jury, and the trial judge found the facts specially. From such special finding it appears that on June 26, 1885, Hinchman, the plaintiff below, was the owner of certain bonds of the county of Leavenworth, state of Kansas, of the total value of $6,500, with interest accrued thereon at the rate of 7 per cent, per annum from March 1, 1887, and that Nelson & Noel, the…
